1. Introduction

This Terms of Service (“ToS”) agreement governs your use of the “3MS” mobile application and related services (collectively, the “Service”) provided by TRIPPLEM SOLUTIONS LLP. By using the Service, you agree to these ToS. If you do not agree, do not use the Service.

2. Service Description

3MS is a multifunctional peer-to-peer platform designed for users in Kerala to conduct direct UPI-based transactions and manage activities such as membership, financial records, donations, events, and more through features like the Joint Account Register (“JAR”).

3. License to Use

3MS grants you a limited, non-transferable license to use the app for personal, non-commercial use in accordance with these ToS.

4. Permitted Use

The Service allows:

  • Membership management with subscription tracking and reminders.
  • Donation collections for trusts with real-time updates.
  • Listings and payments for services and product sales.
  • Use of the Joint Account Register (JAR) for regional financial tracking.
  • Direct UPI payments without 3MS handling the funds.
  • Financial tracking and reporting with downloadable reports.
  • Verification of users and entities for trust and safety.

4.4 Joint Account Register (JAR)

A specialized feature for managing regional group finances, with transparency, access controls, and compliance with Indian data laws.

5. Eligibility

  • Must be at least 18 years old.
  • PAN card required for marketplace activities.

6. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. 3MS may suspend accounts for non-compliance or fraud.

7. Prohibited Activities

  • No illegal, fraudulent, or abusive use of the Service.
  • No malware, unauthorized access, or impersonation.
  • No commercial use without prior consent.

8. User-Generated Content

You are responsible for your uploads and grant 3MS a global license to use such content. 3MS may moderate or remove content at its discretion.

9. Termination

Either party may terminate the agreement. 3MS may terminate your account for violations or inactivity. Data may be retained per legal obligations.

10. Payments and Subscriptions

  • UPI-based payments only.
  • Subscriptions are recurring and managed in-app.
  • Refunds governed by the Refund Policy.

11. JAR-Specific Clauses

Regional group admins must ensure data accuracy and compliance. 3MS offers tools but is not responsible for internal disputes or errors. Users must report violations.

12. Intellectual Property Rights

All platform content is owned by 3MS and protected by applicable IP laws. No unauthorized use is permitted.

13. Disclaimer of Warranties

The Service is provided “as is.” 3MS makes no guarantees and is not responsible for issues related to listed third-party services or products.

14. Limitation of Liability

3MS is not liable for indirect or consequential damages or issues related to third-party interactions. Users must conduct due diligence.

15. Third-Party Services

3MS is not responsible for the content or practices of external links or services accessed through the platform.

16. Indemnification

You agree to indemnify 3MS against any claims or losses arising from your use of the Service or violations of these ToS.

17. Changes to the ToS

3MS may update these ToS with or without notice. Continued use implies acceptance. Notices may be sent via app or email.

18. Right to Modify Terms

3MS reserves the right to modify these terms or subscription details. Users will be notified at least 45 days prior via email or in-app notice.

19. Privacy Policy

These ToS incorporate the 3MS Privacy Policy. Users are expected to handle data responsibly within their groups.

20. Right to Restrict Access

3MS may suspend or ban users for illegal activities or violations. Cooperation with law enforcement may occur if necessary.

21. Force Majeure

3MS is not liable for disruptions due to events beyond its control, such as natural disasters, wars, or cyber incidents.

22. Dispute Resolution

  • First attempt resolution via negotiation.
  • If unresolved, exclusive jurisdiction is with courts in Ernakulam, Kerala.

23. Customer Support

3MS provides dedicated support channels to address user queries or issues.

24. Secure Transactions

All payments occur via UPI. 3MS only facilitates and does not store or process UPI transaction data. Users should contact their banks for UPI issues.
